We are pleased that you have decided to open an account and use our services. SVGator and the services provided are maintained and operated by Smartketer LLC and/or its affiliates ("us," "we," "our," "the Company"). In the context of this agreement, “SVGator" shall mean Smartketer LLC and SVGator site. Please read these Terms carefully and contact us if you have any questions.
SVGator is an online tool designed to simplify the way you create SVG animations. Our goal is to develop a user-friendly, intuitive, online tool that even non-technical persons can use to animate SVG. Thus, we offer this site to aid in the creation of SVG animations.
You or the company or entity that you represent ("you," "your," "yours," or "Customer") acknowledge and agree that by visiting, viewing, using, or accessing SVGator, clicking “Create Account,” “Log in,” “Purchase,” “Save,” or similar links, that you have read, understand, and agree to be bound by these Terms of Use. If you don’t agree to these Terms of Use, then you may not access or use SVGator.
By accessing the website at https://www.svgator.com, you are agreeing to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.
If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
When you create your SVGator account, you must provide us with accurate and complete information. Your account gives you access to the services and functionality that we may establish and maintain from time to time and at our sole discretion. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.
You may not allow any other party to access or use the Service with your unique username and password. You are responsible for safeguarding the password that you use to access SVGator and for any activities or actions under your password, whether your password is with us or a third-party service. You must notify SVGator immediately of any breach of security or unauthorized use of your account. SVGator will not be liable for any losses caused by any unauthorized use of your account.
All materials contained on the SVGator network site are copyrighted by Smartketer LLC and protected to the greatest extent permitted by copyright laws and international treaties. No person is authorized to use, copy, store, modify, or distribute any portion of SVGator. We respect the intellectual property of others, and we ask our customers to do the same.
SVGator.com, Smartketer, and trademarks, service marks, or logos found on the SVGator site are trademarks, service marks, or logos that identify the SVGator site. Such marks may not be used in any form or by any means, for any purpose, without our express written permission. You may not attempt to decompile or reverse engineer any software contained on SVGator's website.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by SVGator at any time.
The Customer owns any content uploaded, created, or saved by the Customer in the My projects and My assets sections, plus all exported SVG files that were created by the Customer. No intellectual property rights transfer. SVGator will not make public or use such materials for advertising purposes without the Customer’s written permission.
By agreeing to these Terms of Service you consent to grant SVGator a world-wide, non-exclusive, and royalty-free license to use your trademark logo and trade name for marketing purposes in the following forms: a) on any website hosted under the domain svgator.com and/or b) in printed or digital marketing materials, including but not limited to: sales pitches, company presentations, case studies, customer lists, blog posts, newsletters, testimonials and press releases.
SVGator will use your trademark logo and trade name only in the versions available on your official website for the above-mentioned purposes.
In this respect, you warrant that the use of the above-mentioned trademark logo and trade name does not infringe any patent, copyright or other rights of industrial, commercial or intellectual property. By accepting these Terms, you also claim that you are the rightful owner of copyright or intellectual properties related to the trademark logo and trade name; furthermore you have the legal right to grant a license in these terms and you have registered the trademark logo and trade name to the relevant trademark authorities worldwide.
You agree that you will indemnify and hold SVGator and its subsidiaries, directors, officers, agents, service providers, affiliates, successors, assignees, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party, due to your breaking of the law, or violating any rights of a third party related to the license rights granted to us with respect to the trademark logo and trade name mentioned above.
SVGator will use procedural, technical, and administrative safeguards designed to ensure the confidentiality, security, integrity, availability, and privacy of Content and other Customer Confidential Information stored in the SVGator Application. SVGator regularly monitors compliance with these measures.
The Customer acknowledges that SVGator’s security measures are subject to technical progress and development and that SVGator may update or modify such measures from time to time provided that such updates and modifications do not result in a material decrease of the overall security of the SVGator Application during a subscription term.
SVGator may offer a Free plan for an unlimited period of time, no credit card required, starting from the date you create an account. SVGator has the right to develop Premium features that are not available to Free users or remove any previously Free features and make them Premium. By accessing or using SVGator, you agree to the terms of any such Free plan and further agree to any changes SVGator may make to this plan.
With the Free plan, you can create and export an unlimited number of static SVG files. You can also test all the Premium features, but the file will be exported with the basic features only.
All video renders are stored in SVGator’s cloud storage. With the Free plan, you can store up to 5 rendered files for a period of 60 days, after which any and all files will be automatically deleted.
To ensure uninterrupted service, all subscriptions (“Subscription”) to SVGator are renewed automatically. Your subscription begins as soon as your initial payment is processed.
You hereby authorize SVGator to store your payment method (Paypal or credit card) and automatically charge Subscription Fees for the monthly/annual renewal until you cancel.
If your payment method fails, SVGator may suspend your subscription. You can edit your payment information anytime in your SVGator account.
All video renders are stored in SVGator’s cloud storage.
The limitations of this feature for SVGator’s paid subscription plans are as follows:
Lite plan: You can store up to 30 files (up to 10 GB storage space) for as long as your Lite subscription plan is active.
Pro plan: You can store an unlimited number of files (up to 100 GB storage space) for as long as your Pro subscription plan is active.
If your paid SVGator subscription plan expires, your subscription will be defaulted to the Free plan. As a result, any and all rendered files will be stored for 60 days, after which they will be automatically deleted, with no possibility of retrieval.
It may happen that you would like to upgrade before the end of your current billing period. You can easily do this without losing a cent. Below you will find how we will calculate your fees at the upgrade, and how it affects your billing cycle at different payment methods.
If you’re using Paypal, your billing cycle will reset automatically and you will get a prorated amount based on the time left from the old subscription.
For example, let's say you want to upgrade from monthly Lite plan to monthly Pro Plan on the 20th day of your current subscription.
As the Lite plan costs $14 for a month, it costs $9.33 for 20 days. So, the remaining amount for this month is $4.67. This sum will be deducted from your new Pro Plan's price and you will be charged only 20.34 instead of the full price of $25 (in the first month).
The billing date becomes the 20th day of the old subscription (the day you create your new subscription) and you will be billed again after 30 days.
If you’re paying with your credit card, there are two possible cases presented below.
- Your billing cycle will remain unchanged if you want to upgrade from Lite annual to Pro annual, or from Lite monthly to Pro monthly. In this case you will pay only the difference for the remaining period.
- If you want to upgrade from a monthly to a yearly plan, your billing cycle will change.
The new billing date will be the 20th day, so you will be billed again, after 1 year, on the 20th day of the month.
If the automatic charge fails on the due date, you will have access only to our free plan until the payment is successful.
- Paypal will try to charge you on day 1, 2, 3, 4, 5, and then on day 11 and day 21. If the charge attempt still fails on day 21, your subscription will be canceled.
- At card payment, there will be 4 attempts to charge you, including the days 1 and 21. If the charge attempt still fails on day 21, your subscription will be canceled.
If you pay your dues manually after the due date, your billing cycle will reset and you won’t be charged for the period when the subscription was in Past Due state.
You can always change or delete your payment method, by following the instructions below.
If you are using a credit card, go to My account -> Billing, and in the Payment method section click on Change.
If you are using Paypal, you will need to cancel the renewal. Then you will be able to delete your payment method and add a new one. It is important to note, that in this case you will have to create a new subscription and your billing period will be reset.
Note: If your subscription has expired, there is no need to cancel the renewal, you can delete your payment method right away.
To delete your payment method, first you have to Cancel the renewal. So first go to My Account -> Billing-> Cancel renewal. After this you will be able to delete your payment method.
You can cancel your subscription anytime via your SVGator account. Please note that such cancellation will only be effective at the end of the then-current Subscription period and your account will stay active until the expiration date. Here you can learn more about how to cancel your subscription.
When the current billing cycle expires, your account will be downgraded to a Free Plan, without losing your projects. If you would like to export your projects again, they will be subject to the limitations of the Free Plan. You can subscribe again to a paid plan anytime.
SVGator has a free version of the application, so that you can test its functionality and assess the product’s value before the acquisition of a premium license.
If you cancel the renewal of your Subscription, you will not receive a refund for any amounts that have been previously charged. As mentioned in the Cancellation Terms above, your cancellation will be effective at the end of your then-current Subscription period, subject to applicable law, and you may use SVGator until your cancellation is effective (unless your access is suspended or terminated as set forth below).
SVGator reserves the right to deny your access to all or any part of the Services, or terminate your account with or without prior notice if you engage in any conduct or activities that SVGator determines, in its sole discretion, violate this Agreement or the rights of SVGator or any third party, or is otherwise inappropriate.
To the maximum extent permitted by applicable law, the SVGator Application, packages, content, and related services are provided “as is”. SVGator makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, SVGator does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
In no event shall SVGator or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on SVGator's website, even if SVGator or an SVGator authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
The materials appearing on SVGator's website could include technical, typographical, or photographic errors. SVGator does not warrant that any of the materials on its website are accurate, complete, or current. SVGator may make changes to the materials contained on its website at any time without notice. However, SVGator does not make any commitment to update the materials.
SVGator has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by SVGator of the site. Use of any such linked website is at the Customer's own risk.
You have no obligation to provide us with ideas, suggestions, or proposals (“Feedback”). However, if you submit Feedback to us, then you grant us a non-exclusive, perpetual, irrevocable, and royalty-free license to any intellectual property rights you may have in your Feedback to use, publicly display, or distribute the Feedback.
SVGator may revise these Terms of Service for its website at any time without notice. We will let you know either by posting the modified Terms on the Site or through other communications. The continued use of or access to our website or the service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
These terms and conditions are governed by and construed in accordance with the laws of California and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
